Common Partner Visa Mistakes to Avoid
Avoid these critical mistakes that can lead to partner visa refusals or significant delays in your application.
Insufficient relationship evidence
The Department requires comprehensive evidence of a genuine relationship across four categories: financial, social, household, and commitment. Weak evidence in any category can lead to refusal.
Applying for the wrong visa subclass
Applying for an onshore visa when you are offshore (or vice versa) can result in your application being invalid. Choosing the correct subclass based on your location is critical.
Not meeting the de facto relationship requirement
De facto couples generally need to demonstrate they have been in a genuine relationship for at least 12 months before applying. Applying too early without sufficient evidence can lead to refusal.
Failing to update the Department during processing
Partner visa processing can take years. Failing to notify the Department of changes in your circumstances — such as address, relationship status, or new children — can jeopardise your application.
Attempting to apply without professional guidance
Partner visa applications are complex and highly document-intensive. Without professional guidance, applicants often miss critical evidence requirements, leading to unnecessary refusals.

Frequently
Asked Questions
What is the difference between the Subclass 309 and Subclass 820 partner visa?
The key difference is your location at the time of application. The Subclass 309 (offshore partner visa) is for applicants who are outside Australia when they apply. The Subclass 820 (onshore partner visa) is for applicants who are in Australia when they apply. Both are temporary visas that lead to permanent residency — the 309 leads to the Subclass 100, and the 820 leads to the Subclass 801.
How long does a partner visa take to process in Australia?
Partner visa processing times vary significantly. The temporary stage (Subclass 309 or 820) can take anywhere from 12 to 24 months or longer depending on the complexity of your case and the Department's current workload. After the temporary visa is granted, you must wait at least 2 years from the original application date before the permanent stage (Subclass 100 or 801) can be assessed. Our migration agents can advise you on current processing times and how to best prepare your application.
Can de facto couples apply for a partner visa in Australia?
Yes, de facto couples are eligible to apply for an Australian partner visa. Generally, de facto couples must demonstrate they have been in a genuine de facto relationship for at least 12 months prior to applying. Same-sex de facto couples are equally eligible. You will need to provide comprehensive evidence of your relationship including financial ties, shared household, social recognition, and commitment to the relationship.
What evidence do I need for a partner visa application?
Partner visa evidence is assessed across four categories: (1) Financial — joint bank accounts, shared assets, joint financial commitments; (2) Household — shared lease or mortgage, shared utilities, household responsibilities; (3) Social — joint social activities, recognition by family and friends, photos together; (4) Commitment — correspondence, travel together, knowledge of each other's personal circumstances. The stronger your evidence across all four categories, the better your chances of approval.
What is the Subclass 300 Prospective Marriage Visa?
The Subclass 300 Prospective Marriage Visa (also known as the fiancé visa) allows you to travel to Australia to marry your Australian citizen partner. You must be outside Australia when you apply and intend to marry your partner within 9 months of arriving in Australia. After marrying, you can then apply for a partner visa (Subclass 820/801) to remain in Australia permanently. You must have met your partner in person before applying.
Can I work in Australia while my partner visa is being processed?
If you are applying onshore (Subclass 820), you may be granted a Bridging Visa A which allows you to remain in Australia and work while your application is being processed. If you are applying offshore (Subclass 309), you will need to wait outside Australia until your visa is granted before you can enter and work in Australia. Once your temporary partner visa is granted, you will have full work rights in Australia.
